		<description>I am aware of that portion in the copyright
law.  It is not clear from your initial post
on how you can claim that MP3 is in the
public domain.  It could be done by a
private person in the audience in the court
room.

Unlike the copyrighted works, the works that
are supposed to be in the public domain
require a bit more documentation to
prove that they are truly in the public
domain.

For those who want to go to the source,
go to &lt;a href="http://www.ca9.uscourts.gov/" rel="nofollow"&gt;http://www.ca9.uscourts.gov/&lt;/a&gt; and click
on the box for audio files.  Then, enter
the court case number "03-55894".  You will
not get MP3 but you will get WMA.
